Rental of electric bicycles from RomaBikes.it, hereinafter referred to as “the Company” is governed by this Rental Terms and Conditions Agreement.

Terms & conditions to use our rental services

Everyone who likes to rent a bicycle, hereinafter referred to as “the Renter” shall provide a valid ID card or Passport, fill out and signs the Rental Receipt. The Renter shall provide true personal information upon signing this Rental Terms and Conditions Agreement. In case of a a group of clients, the Rental Receipt can be signed by only one Renter, providing nonetheless all required personal identity information of all riders of the group.
Upon renting of the bike, the Renter shall inspect the bicycle, and if accepted it, the Renter shall sign the Rental Receipt thus confirming perfect working condition of the bike. The Renter shall inform the Company of any problem on the bike prior to leaving the Company’s shop. The Renter shall return the bike in the same condition as received at the agreed location. The Renter shall return the bike on time as noted in the Rental Receipt. The Renter who returns a damaged bike, if the bicycle has not been damaged due to deliberate conduct of the Renter, shall replace the bike with another one in perfect working condition. If the damage has been caused by a wrong conduct of the Renter, the Company shall reserve the right to charge the costs to replace broken parts of the bike to the Renter.
At the time of rental a bike, the Company shall require a credit card. The amount is relative to the rental conditions plus half of the value of the rented bicycles, and will be reserved on the credit card during the rental period. The deposit is mandatory. Upon return of the bike, the company returns the amount of the deposit. If the Renter doesn’t have a valid credit card, he the Renter shall make the payment of rental and deposit by cash.

Who can use the rental services

Bicycles can only be used by adults (18 years old). Minor can use bicycles only if accompanied by adults who shall assume every responsibility for any damages caused by a minor. The Company may decline to deliver a bike to a person who, in his opinion, is not capable of riding a bicycle.

Terms and conditions of use

The price for rental bikes is fixed in the Price List displayed in the Company’s shop and online. The Renter shall use the bike with due care and diligence. The Renter shall use the bike only on roads according to road and traffic regulations. The bicycle shall be used by the Renter at his own risk. The use of bikes for commercial purposes or subrental activities is strictly prohibited. The transport of dangerous or illegal goods is forbidden. Cycling under the influence of medicines, drugs or alcohol, is strictly prohibited. The Company where bicycle are rented shall not be held responsible for damages or incidents caused by improper use of bicycle.
The Renter shall not leave the bicycle unlocked or unattended. Rental fees do not cover for damages caused by theft. By signing the Rental Receipt the Renter ensures to be physically and mentally fit to ride the bike, and to assume every responsibility.
In case of late return of the bike, the Renter shall be charged of a penalty calculated according to the Price List increased by 20%.

Booking the bike

The reservation of the bike is confirmed when the payment is completed. In case of cancellation made at least 3 days before the date of the rental period, the deposit will be fully refunded after deducting the cost of 4% transfer fees.

Renter’s liability for damage

The Renter shall be liable at any time during the rental period for any event or damage caused to him or to a third person. In case of damage caused by a non proper use of the bicycle, the Renter shall reimburse the Company the total costs of the damage. Damage shall be assessed by the Company shop staff in accordance with the Price List published in the Company shop. If the Renter doesn’t return the bike, or returns the bike with parts broken, the Renter shall be charged of the total costs to replace the bike with a new one.
In case a third party should steal the bike from the Renter, or if the bike is damaged in a traffic accident, with an official report issued by the Police, the Renter shall be charged only for the deposit, rather than full value of a new bike.
If the bicycle is not returned within 12 hours of the return due time, the Company shall inform the Police.

Right of Withdrawal

In case the Renter breaks the rental rules, the Company shall be entitled to withdraw from the Rental Terms and Conditions Agreement. with immediate effect and to take back the bike from the Renter.
By signing the Rental Terms and Conditions Agreement, the Renter accepts all the terms of this Agreement. The Renter shall withdraw from the Rental Terms and Conditions Agreement and return the bike only if there is a defect in the rented bike and the Company has no replacement bikes available. The Company shall pay back to the Renter in proportion to remaining rental time.

Jurisdiction

Any dispute arising from the Rental Terms and Conditions Agreement shall be governed by the Italian Law and jurisdiction is the Court of Rome, Italy.
